 ENGLISH PARTY

ENGLISH LIBERAL DEMOCRATS APPEALS PANEL

We understand that you may wish to appeal to the above panel.  In order that we may first decide whether we are the right body to consider the issue you wish to raise, we ask that you complete the form below as succinctly as possible.

1.            Name: Dr Shantanu Panigrahi

Address: 3 Hoath Lane, Wigmore, Gillingham, Kent ME9 0SL, United Kingdom.

                   Telephone:      07967789619                E-mail:shantanupanigrahi@yahoo.com

                    Party Membership Number: 24041198559

2.            The details of the Party body or officer/s with whom you are in dispute (with names as necessary): Lead Adjudicator who has not provided me with his/her name.

3.            The grounds for your proposed appeal (n.b. the Panel will not simply re-hear your case): I am informed that my attempt at rejoining the Liberal Democrats on 1 April 2024 was refused for internal Party reasons that despite me seeking clarification it was not provided. I observed all the procedures of the Party very carefully with the assistance of the Standards Officer, but the Lead Adjudicator on a review of those interactions passed a judgment that I had been a Vexatious Complainant, as linked here: https://www.thelibertariandemocrats.com/forum/liberal-democrats-uk/liberal-democrats-standards-office-complaint-notification-case-ref-768909

It is unjust and immoral to say the least that it without discussions with myself as to where I had gone wrong with the due process of the complaint that the Lead Adjudicator would enter what I described as being obnoxious to the Mr Lucas North of the Regional Party Committee in my email on 24 June 2024 the Lead Adjudicator is still not engaging with me in discussions. Mr Lucas North had replied as follows:

Hi Shantanu,

Thank you for your email. I note from the correspondence you attached that you have been labelled a vexatious complainant. This is a reserved decision for the Lead Adjudicator in the Federal complaints process, and neither myself nor the RPC have taken a view on the decision.

However, the decision does not preclude an appeal to the English Appeals Panel regarding our decision on your membership. You have a constitutional right to appeal the decision to the EAP. Please note that such an appeal is unlikely to be considered until after the U.K. General Election on 4th July.

Best wishes,

Lucas

> However, this morning Mon, 24 Jun at 10:15, I received an email from the Standards Officer Liberal Democrats as linked https://www.thelibertariandemocrats.com/forum/liberal-democrats-uk/liberal-democrats-standards-office-complaint-notification-case-ref-768909    consisting of a decision to prohibit me from lodging the appeal for 12 months by judging me to be a Vexatious Complainant.

> There was no further communication to me by the Standards Officer or the Lead Adjudicator directly setting out the Full Written Reasons for the decision taken against me.

> Whereas I would have used the opportunity that the RPC has given me in stating that ' You have the right to appeal its decision to the English Appeals Panel and that any appeal must be made within 14 days and on the correct form, you do not mention whether the RPC has endorsed the report of the Lead Adjudicator.

> Furthermore I have no plans to wait for a full year as the Lead Adjudicator stresses to file my Appeal of the RPC's decision to the English Appeal Panel.

4.            The ruling that you would wish the Panel to make in your favour: (a) I would apply for a reconsideration of the decision of the Lead Adjudicator as the first necessary step before (b) the matter of my eligibility to rejoin the Liberal Democrats through an Appeal of the Regional Parties Committee is considered by the English Appeals Panel. The Lead Adjudicator must furnish the Full Written Reasons for his/her assessment. The original decision of the Regional Parties Committee is linked here: https://www.thelibertariandemocrats.com/forum/liberal-democrats-uk/membership-of-the-liberal-democrats-in-england

Please return this form within fourteen days to:  Standards Officer at standardsofficer@libdems.org.uk,  or by post to Office of the English Party, LDHQ, 1 Vincent Square, London, SW1P 2PN.

If it is decided that your case does fall within the remit of the Appeals Panel, you will be asked immediately for further information and a date for your hearing will be fixed.

Please state here any dates that you will not be available:

Please note this extract from English Party constitution article 9.6:

9.6 Any decision of the Panel shall, subject to any right of appeal under the Federal Constitution, be final and binding on all concerned. The Panel shall publish any decisions, which, in the opinion of the Chair, are likely to be of value as a precedent.
